By requesting electric service, the Applicant(s) hereby applies for membership in Twin Couty Electric Power Association, an electric power association organized and operating under the laws of the State of Mississippi (the “Association”), and agrees to purchase electric energy from the Association upon the following terms and conditions:

Terms & Conditions of Membership & Service Agreement
Applicant (singularity or collectively) represents that he/she is 18 years of age or older and can satisfy the required identification verification.
Applicant represents that he/she lawfully owns, controls, or occupies the real, personal, and intangible property for which service is provided by the
Association (the “Property”). If there is more than one-applicant, and the applicants are legally married, then they are applying for a joint membership
in the Association and shall be jointly and severally liable to the Association. If the applicants are not legally married, then the membership shall be
in the name of the applicant and the co-applicant shall be a guarantor for the account.
Applicant agrees to be bound by the provisions of the Association’s Articles of Incorporation (Charter), By-Laws, and policies, rules and regulations as
they currently exist or as they are later adopted, amended or restated.
Applicant shall cause the Property (including any renovations or additions thereto) to be wired or re-wired in accordance with the specifications of the
National Electric Code, National Electric Safety Code, or any other applicable state or local government ordinance. Applicant further agrees to comply with
and be bound by the applicable rules and regulations of the Mississippi Public Service Commission.
Applicant agrees that the connection of the Association’s electrical service lines to the Applicant’s Property shall not in any way or manner constitute
the Association’s approval of the Applicant’s wiring or the safety or adequacy of the Property. Applicant shall be responsible for and shall indemnify and
hold harmless the Association and all of its members, directors, officers, employees, agents, and independent contractors (together with their heirs,
executors, administrators, successors and assigns) against death, injury, loss, damage or claims resulting from any defect in or use of, or maintenance
of such Property and all wiring apparatus connected thereto or used thereon. In no event shall the Association be responsible beyond the point of delivery,
which shall be where the Association’s service lines are attached to Applicant’s service entrance.
Applicant shall make available to Association a suitable site, as determined by Association, to place Association’s physical facilities for furnishing and
metering electric service and shall permit Association’s employees, agents or independent contractors to have access for inspection, operation, maintenance,
replacement, relocation or repair of facilities at all reasonable times.
Applicant agrees to allow Association to use AMR and AI technology to collect information regarding its members’ electric usage and other matters directly
related to the Association’s infrastructure.
Applicant agrees that he/she shall not interfere with, impair the operation of, or cause damage to any of the Association’s facilities, and shall use
his/her best efforts to prevent others from doing so. Applicant shall not install property or apparatus on any of the Association’s poles or equipment.
Applicant agrees to pay a membership fee and all other required fees for service connection, security deposit, facilities extension, contribution in aid
to construction, or any combination thereof as set forth in the Association’s policies. Applicant also agrees to pay required fees for additional service
locations. Applicant agrees to pay for electric service on a monthly basis at the applicable rate, plus applicable taxes, by the due date thereof as
determined by Association’s Board of Directors from time to time. Any electrical energy connected with the Association’s facilities shall be subject to
rules and regulations adopted, from time to time, by the Association’s Board of Directors. Applicant agrees to pay a minimum monthly service charge and
power contract requirement (where applicable), plus applicable taxes, regardless of the number of kilowatt hours consumed.
Applicant consents for the Association to contact him/her by telephone, e-mail, text message, pre-recorded or artificial voice message and/or the use of
automatic dialing devices. Applicant acknowledges that some of the methods of communication may result in fees being imposed to the Applicant, and Applicant
agrees that he/she shall be responsible for payment of all such fees. Applicant may revoke his/her consent to such contacts by contacting any of the
Association’s offices. Applicant agrees that he/she shall promptly notify the Association of any changes in his/her telephone number, e-mail address and/or
cell phone number.
Applicant authorizes Association to request, receive, and/or evaluate information from a consumer reporting agency (credit bureau), financial institution
or other individual or entity regarding the Applicant’s creditworthiness, credit standing, or credit capacity. The foregoing authorization includes, without
limitation, the Association’s use of such information to establish the amount of Applicant’s deposit, if applicable.
Applicant agrees that the Association shall have the right to disconnect electric service in the event the Applicant fails to pay all amounts due in
accordance with the Association’s policies, rules and regulations. If Applicant requests termination of electric service, Applicant agrees to give 5 business days’ notice to Association, and Applicant agrees to pay for energy usage until Association has disconnected the Applicant’s service. After
termination of service, Applicant agrees to pay the final bill amount submitted by Association. Applicant agrees to be responsible for all collection costs,
including reasonable attorneys’ fees and expenses incurred by the Association for collection and repayment of any amount outstanding.
Pursuant to terms and conditions specified by the Association and without financial compensation from the Association, Applicant agrees to grant to the
Association an easement, right of way and the right of ingress and egress upon the Property for the purpose of providing electric service and other
services to the Property and to other persons, and agrees to execute a document to evidence such easement, right of way or right of ingress and egress.
The Association shall also have the right to perform all acts that it deems necessary in constructing, operating, maintaining and repairing electrical
lines, poles, and equipment, including the clearing and maintaining of such right of way.
Without limiting any of the foregoing, applicant acknowledges and expressly agrees to be bound by the “alternative dispute resolution” provisions as set forth in Article XI Section 11.06 of the association’s bylaws and any amendment(s) thereto.
The acceptance of this Application for Membership & Service Agreement by the Association’s Board of Directors shall constitute an agreement between
Applicant and the Association for membership in the Association and to furnish electric service to such Applicant. Applicant agrees to comply with these
Terms & Conditions and any and all subsequent changes thereto. Applicant agrees that this agreement shall be governed and interpreted under the laws of
the State of Mississippi.
